This Case Epilogue written February 1, 2017 is intended to provide context to this web site as it documents a Canadian constitutional challenge spanning from 2004 to 2016. Bruce Montague determined to expose the constitutional violations in the Canadian Firearms Act. After being charged, mounting a constitutional challenge and appealing to the Supreme Court of Canada, Montague's case was dismissed without reasons. With Bruce in jail, the Montagues then faced an another twist of injustice -- the confiscation of their home and property by the Ontario government. The Montagues fought the civil forfeiture of their home for years until, in the summer of 2016, the Canadian Constitution Foundation was instrumental in negotiating with the Ontario Civil Forfeiture department to drop the lien against the Montague home. The Canadian Constitution Foundation deserves our support as they continue to fight other cases of injustice around the country. YOU COULD BE NEXT! Sep14-10: [Scrap C-68] Supreme Court to announce its decision on whether it will hear our appeal.

Dear Supporters:

It's been just over 6 years now since my arrest (Sept 11, 2004) and we're still hanging in! I must admit I'm getting battle weary but still have the resolve to see this through because "it's the right thing to do!".

I just got this news in this morning from my lawyer. It's an e-mail from the "justice" department that the Supreme Court of Canada (SCC) has reviewed our application to appeal our case to the Supreme Court. Following is what that e-mail said:

"[On Sept. 13th] the Supreme Court of Canada announced [today] that it will be releasing its decision on this leave application on Thursday September 16, 2010 at 9:45 a.m."

I'm currently out on bail but must now turn myself back in to jail before the decision is made. I'm not sure how long I'll be held for, but much of that depends on what the decision is. So it looks like I'll be out of touch for a while but I would really welcome all your prayers during this stressful time for both myself and my wife and kids. Your prayers have helped us through this for over 6 years now and we have a lot to be thankful for, including:


1.. Donna and I still have our health
2.. Donna still has a good job.
3.. All 3 of our kids are progressing very well in their university courses.
4.. Legal-wise we are right on track (so far) for having our constitutional claim heard at the Supreme Court of Canada.

I would specifically like to ask for prayers at this time that the Supreme Court will seriously consider our claim in an unbiased manner so that the rights and freedoms of all Canadians are respected.

You should expect a newsletter from someone in our case management team this Thursday letting you know what the SCC decision is. In the meantime, God bless!
